If you’ve been injured in an accident, you may not know whether or not you have a case or whether the personal injury attorney you’re speaking to is qualified to handle your particular type of lawsuit. Some personal injury lawyers prefer to handle just one sort of claim, but most are qualified to handle multiple accident types. Make sure that you know which category of personal injury law that your claim falls under and that the lawyer you’re speaking with has experience in that area of the law.

Types of Personal Injury Cases

The following is a list of the most common personal injury cases in Florida:

Motor Vehicle Accidents

These include any collision with a car, motorcycle, or commercial truck, but they also include vehicle collisions with pedestrians and bicyclists. These accident claims are usually settled by the insurer that covers the vehicle.

Boating Accidents

Boating accidents cover boating collisions, waterskiing accidents, jetskiing accidents, and other types of accidents involving operating a vessel on the water.

Premise Liability

After motor vehicle accidents, premise liability accidents are possibly the most prolific in the state of Florida. In addition to slip and fall accidents, premise liability covers any sort of accidental injury that’s caused by a lack of due care on the part of the property owner or custodian, including burns, falling items, electrical shocks, injuries due to negligent security, et cetera.

Product Liability

Any product that’s sold to consumers must be safe or have the appropriate warnings about the risks associated with using that product. There are three types of product liability cases: manufacturer defects, design defects, and mislabeling of products.

Wrongful Death

Death due to someone else’s negligence is actionable by the survivors. Wrongful death suits must be brought forth within two years of the date of death in the state of Florida, when the statute of limitations expires.

Medical Malpractice

Individuals employed in the medical profession owe a duty of care to the patients they treat. That’s not to say that they owe their patients a guaranteed outcome, but the advice and treatment that they do provide must meet the standards of their profession.

Dog Bites

The owners of pets assume the responsibility for their actions. If a dog bites an individual, the owner is liable. If you’re the victim of a dog bite, you’re entitled to compensation.

How to Receive Compensation for Your Injuries

If you’ve been injured in an accident, you must take certain steps to ensure that you have a solid claim. Get medical treatment immediately so that you have documentation as to your wounds. Photograph any injuries or physical damage. For instance, if you’re injured in a car accident, take pictures and videos of the vehicles and street from a safe place. Finally, contact a personal injury lawyer who handles your type of claim.

Personal injury lawyers in Florida work on a contingency basis. That means that they are only paid once your claim settles or you win a court award. The percentages that they can claim in Florida is established by the state bar. For most types of accidents, the statute of limitations is four years, but in a wrongful death action, the time limit is two years from the date of death. For this reason, you should not delay making your claim.
